Website Terms of Use

Effective date: 25 August 2026Last updated: 25 August 2026

1. About these Terms

These Terms govern access to and use of niluza.com.

Niluza is currently a business in formation and coordinates Naga King Chilli trade enquiries from Dimapur, Nagaland, India. Until formal company particulars are published, “Niluza”, “we”, “us”, and “our” refer to the person or business operating the website and responding to enquiries.

By using the website, you agree to these Terms. If you do not agree, do not use it. Contact: contact@niluza.com.

2. Informational and enquiry-only website

The website provides general information about Niluza’s proposed trade focus and lets prospective buyers submit enquiries. It is not an online shop, marketplace, firm product offer, ordering or payment facility, auction, tender, booking platform, or guarantee that any product, quantity, packing format, documentation, route, or timing is available.

Submitting an enquiry, receiving a response, or discussing possible terms does not create an order, reservation, agency, partnership, or binding contract.

3. No offer or automatic acceptance

Website content is an invitation to make an enquiry, not an offer capable of acceptance. A transaction arises only if authorised parties enter separate, express commercial terms. Those terms may address specifications, quantity, price, currency, payment, packing, testing, documentation, delivery basis, risk, title, inspection, claims, and disputes.

Any quotation, pro forma invoice, specification, or commercial document issued later remains subject to its own conditions and validity period. Niluza may accept, decline, or request further information concerning any enquiry.

4. Product, availability, and routing information

The website presently discusses fresh whole and dried whole Naga King Chilli from Nagaland. All product and trade information is general and subject to transaction-specific verification. In particular:

  • fresh-product availability is seasonal and destination dependent;
  • dried-product availability is order dependent;
  • air or sea routing depends on product condition, quantity, destination, and practical feasibility;
  • packing may require separate discussion;
  • import, export, phytosanitary, testing, labelling, and documentary requirements vary by product and destination; and
  • images are illustrative and do not establish the specification, grade, size, colour, quality, condition, or packing of a future shipment.

Prospective buyers must independently identify and verify destination import, food-safety, labelling, customs, and other requirements. Responsibility for compliance in a transaction will be established in separate commercial terms.

5. Indicative minimum order quantity

The website states an indicative MOQ from 50 kg. This is not a commitment to supply 50 kg or any other quantity. Starting quantities may vary according to product, season, availability, packing, destination, routing, supplier capability, and commercial viability. Any applicable minimum will be confirmed only for a specific enquiry.

6. Documentation and status statements

Statements about registrations, testing, specifications, or documents reflect the status stated at the relevant time. The website currently indicates that:

  • product and origin descriptions are available;
  • phytosanitary documentation is order or destination dependent;
  • company and export registration is in progress; and
  • laboratory specification records are planned.

“In progress”, “planned”, “under consideration”, or similar words do not mean completed, granted, issued, certified, or available. Nothing claims a licence, registration, certification, test result, or approval unless expressly identified as confirmed and supported by evidence.

7. Accuracy and changes

We aim to present information responsibly, but it may contain errors, omissions, or become outdated. To the extent permitted by law, we do not warrant that content is complete, current, error-free, or suitable for a transaction. We may change, suspend, or remove content, product descriptions, or enquiry functionality. Verify material commercial details directly before relying on them.

8. Your enquiries and responsibilities

When submitting an enquiry, you agree to:

  • provide information accurate to the best of your knowledge;
  • act for a genuine business or professional purpose;
  • have authority to provide information about the identified company;
  • avoid impersonation;
  • avoid unlawful, misleading, infringing, harmful, or fraudulent material;
  • avoid passwords, payment credentials, government identifiers, or unnecessary sensitive information; and
  • comply with applicable laws.

You are responsible for reviewing the accuracy of specifications, destinations, quantities, dates, and requirements you provide. We may disregard or block abusive, automated, fraudulent, unlawful, or irrelevant enquiries.

9. Permitted use

You may use the website for lawful informational purposes and genuine trade enquiries. You must not interfere with the website or its security; attempt unauthorised access; introduce malware; overload, disrupt, or probe it; scrape or harvest in a manner that burdens the site or infringes rights; collect personal information about others; commercially exploit substantial content without permission; misrepresent an association with Niluza; or use the site for unlawful, deceptive, or abusive activity. Ordinary indexing by legitimate public search engines is not prohibited.

10. Intellectual property

Unless otherwise stated, the website’s branding, logos, text, layout, graphics, photographs, and original content are owned by or licensed for use by Niluza and protected by applicable law.

You may view the website and make a reasonable copy of relevant information for internal evaluation of a potential trade enquiry. No other licence is granted. You may not reproduce, modify, distribute, sell, publicly display, or commercially exploit content without prior written permission, except where law expressly permits. Third-party names and marks remain their owners’ property.

11. Information you submit

You retain rights you hold in submitted materials. You give Niluza limited, non-exclusive permission to use, copy, and share them only as reasonably necessary to assess and respond to the enquiry; discuss it with relevant personnel, advisers, or potential fulfilment participants; comply with law; and protect legal rights.

Do not submit trade secrets or third-party material unless authorised and appropriate protections are agreed. Submitting the standard form does not create a confidentiality or non-disclosure agreement. Personal data is handled under the Privacy Policy.

13. Website availability and security

We do not guarantee uninterrupted or error-free access. The site may be unavailable due to maintenance, faults, security events, internet conditions, or circumstances beyond reasonable control. You are responsible for security on your devices, networks, and communications.

14. Disclaimers

To the extent permitted by law, the website and content are provided on an “as available” basis. Niluza disclaims implied warranties concerning merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and results arising from website use. Nothing excludes a warranty or right that applicable law does not permit the parties to exclude. Product fitness, compliance, and commercial warranties, if any, will be determined only by separate transaction documents.

15. Limitation of liability

Nothing excludes or limits liability where prohibited by law, including liability for fraud, fraudulent misrepresentation, or wilful misconduct.

Subject to that qualification, Niluza will not be liable merely because an enquiry is declined or receives no immediate response; a product, quantity, route, document, or timing is unavailable; indicative information differs from verified information; you rely on content without transaction-specific confirmation; or a third-party site or service causes loss.

To the maximum extent permitted by law, Niluza will not be liable for indirect, incidental, special, or consequential loss arising solely from use of this informational website, including loss of anticipated profit, opportunity, goodwill, or data.

If liability arising solely from website use cannot lawfully be excluded, Niluza’s aggregate liability is limited to a reasonable amount in Indian Rupees to be confirmed after legal review. This cap does not govern liability under a separate supply agreement.

16. Indemnity

To the extent permitted by law, you will reimburse Niluza for reasonable, direct losses, liabilities, and third-party claims resulting from unlawful or fraudulent website use; material submitted without necessary rights or authority; material breach of these Terms; or deliberate interference with website security or operation. This does not apply to the extent loss was caused by Niluza’s negligence, unlawful conduct, or breach of duty.

17. Suspension

We may restrict or block access where reasonably necessary to protect the website, investigate misuse, comply with law, or enforce these Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to mandatory law and dispute provisions in separate commercial terms, the courts at Dimapur, Nagaland will have exclusive jurisdiction over disputes arising from these Terms or website use. This jurisdiction clause should be confirmed against the operator’s legal identity, principal place of business, and counsel’s advice before formal publication.

19. Changes to these Terms

We may update these Terms to reflect changes to the website, business, or law. The updated version will be posted with a revised date. Changes apply prospectively unless applicable law requires otherwise.

20. Severability and waiver

If a provision is invalid or unenforceable, it will be limited or removed only as necessary, and the remainder continues. Failure or delay in enforcement is not a waiver.

21. Entire agreement for website use

These Terms and the Privacy Policy constitute the agreement concerning website use. They do not replace separate confidentiality, quotation, purchase-order, supply, or other commercial terms expressly agreed by authorised parties. If signed commercial terms conflict on a transaction-specific matter, those terms prevail for that matter.
